Canada LMIA Global Talent Stream: Service Canada’s 2026 Clarification on ‘Employer’ Definition – Agencies & Contractors Beware!

Quick Navigation:
I. Service Canada's Latest Clarification on the Definition of "Employer"
On September 18, 2026, Service Canada added an "Employers" section to the Global Talent Stream official requirements, further clarifying: Does the company applying for an LMIA truly qualify as the "employer" of the foreign worker?
This update is particularly noteworthy.
II. Who is Considered a "Real" Employer?
Service Canada will examine the following core elements to determine whether a company genuinely qualifies as an employer:
- Pays wages
- Determines work location, time, and methods
- Manages and supervises employees and their work performance
- Responsible for payroll, CPP/EI/income tax, and other statutory deductions
- Has the authority to hire and dismiss employees
III. Two Situations to Pay Special Attention To!
1. Special Attention for Staffing / Employment Agencies!
If a company merely recruits employees for other businesses but lacks a genuine employer-employee relationship, Service Canada explicitly states that it cannot hire a Temporary Foreign Worker under its own name and then assign them to work for other companies.
2. Foreign Workers Cannot Be Classified as Independent Contractors!
After LMIA approval, employees cannot be reclassified as contractors or use invoices or other arrangements to circumvent payroll, wage, and TFW Program requirements.
IV. Consequences of Non-Compliance
Employers who fail to comply may face:
- LMIA application denial
- Administrative penalties
- Prohibition from using the Temporary Foreign Worker Program
V. Does Your Company Need to Re-examine its Employment Structure?
📌 Staffing, Trucking, Subcontractor, and dispatch companies, in particular, should re-examine their existing employment structures.
If your company is preparing an LMIA, in addition to job duties, wages, and recruitment requirements, the actual employer-employee relationship between the employer and the foreign worker will also be a very crucial aspect.
Need an assessment for your LMIA or employer qualification?
Service Canada's scrutiny of employer qualifications is increasingly strict. Ensuring the authenticity and compliance of your application is paramount.
